Olivet will process a Site Plan/Special Permit Application <br />before the Planning Board in connection with its overall development plan for the former Harlem <br />Valley Psychiatric Center. <br />As you know, the Town Code indicates that no CO is required for any building, <br />such as the Chapel, that was constructed prior to the adoption of the Town Zoning Code. The <br />Town Code provides that "[n]o building or structure hereafter erected, constructed, enlarged, <br />altered, or moved, and no enlarged, extended, altered, or relocated portion of an existing building <br />or structure, shall be occupied or used until a [CO] has been issued." (Town Code § 145-56 <br />(emphasis added).) Similarly, other Code provisions confirm that a CO is only required in <br />connection with building construction or alteration conducted after the adoption of the Town <br />Code.
