SEQR Lead Agency Coordination Response <br />Olivet Center <br />October 28, 2015 <br />Page 2 <br />Further, based upon our review of the circulated documents, it appears that the project <br />will require the Department permits that are indicated below: <br />Dam Safety — The concrete dam on the Olivet Center site (I D#230-0677) is a Class <br />C High Hazard Dam in need of repair to bring the dam into conformance with <br />current dam safety criteria. Department staff have communicated their concerns <br />regarding deficiencies of the dam in a number of discussions and exchanges of <br />correspondence, initially with sponsors of the Dover Knolls project, and most <br />recently via letter from Donald Canestrari, P.E., of DECs Dam Safety Section to <br />Olivet Management, LLC, dated September 16, 2015. Mr. Canestrari's letter <br />requested a written response by October 23, 2015 regarding Olivet's plans to <br />either perform the necessary repairs to the dam or to lower the impoundment to <br />reduce risk of dam failure. Any repair or rehabilitation of this State registered dam <br />requires a Dam Safety permit from the Department. We continue to await a <br />response from Olivet Management, LLC, regarding .their intentions regarding <br />necessary repairs to the deteriorated dam. <br />2. Protection of Waters (Article 15) - The reservoir located on the Olivet Center site <br />is a Class A protected New York State body of water under Use and Protection of <br />Waters regulations (6 NYCRR Part 608). The circulated Phasing Plan (Exhibit 2) <br />shows a proposed picnic area and storage shed on the western embankment of <br />the reservoir. In addition, a prior proposal to repair the reservoir dam included <br />dredging sediments from the upstream face of the dam. A Protection of Waters <br />permit (Excavation/Fill) would be necessary for any proposed excavation or fill <br />below mean high water of the reservoir, including any proposed dredging to <br />facilitate dam repairs., [See also Threatened(Endangered Species below.] <br />3. Freshwater Wetlands - The Olivet Center site contains portions of three (3) NYS <br />Freshwater Wetlands: DP -22 (Class 1); DP -30 (Class III); and DP -35 (Class 11). A <br />Freshwater Wetlands permit is required for any physical disturbance within these <br />three NYS Freshwater Wetlands or within their respective 100 foot adjacent areas, <br />including proposed stormwater outfalls. The circulated Phasing Plan (Exhibit 2) <br />shows proposed staff housing located at the northwestern portion of the parcel in <br />the vicinity of FW DP -30. In addition, the plan shows a number of proposed <br />recreational facilities (soccer field,. tennis & basketball courts, temporary offices & <br />parking, etc.) north of Wheeler Road and east of NYS Route 22. Please be aware <br />that FW DP -30 extends southward into these areas and proposed disturbances <br />may be within the regulated area of Freshwater Wetland DP -30. Please also be <br />aware that NYS Freshwater Wetlands on the Olivet Center site were delineated in <br />2006 [for the previously proposed Dover Knolls project]. Plans incorporating the <br />wetland and adjacent area boundaries were validated by the Department April 18, <br />2007 and are valid until April 18, 2017. Specifically, plans entitled "DEC Wetlands <br />Map, Knolls of Dover, Hutchinson Avenue, Town of Dover," prepared by Evans <br />Associates Environmental Consulting, Inc., dated March 16, 2007 (Sheet Nos. 3 & <br />4),, show validated wetland lines for those areas to be developed or otherwise <br />disturbed under the current proposal for the Olivet Center project.
