State Pollutant Discharge Elimination System (Article 17) - <br />A. Sanitary Discharge: For the proposed surface discharge of 209,900 gallons per <br />day (gpd) of sanitary wastewater from the existing wastewater treatment system <br />(Phase I discharge 42,345 gpd). As the current SPDES permit for the facility <br />(SPDES# NY 003 2158) approves discharge of 1.2 million gallons per day <br />(MGD), the SPDES permit must be modified to reflect reduced discharge flow. <br />In addition, the current SPDES permit was issued to the previous project <br />sponsor, Dover Knolls Development Co. II, LLC:_ The facility's current SPDES <br />permit should be transferred to Olivet Management, LLC, as the current <br />responsible party. <br />B. Stormwater: Stormwater discharges resulting from construction activities that <br />disturb one or more acres must comply with the current SPDES Stormwater <br />General Permit (Stormwater Discharges from Construction Activities, <br />GP -0-15-002). As the circulated EAF indicates, the action will disturb a total of <br />approximately 60 acres (Phase I will disturb 13 acres), a Stormwater Pollution <br />Prevention Plan (SWPPP) must be prepared which conforms to requirements <br />of the General Permit. <br />5. Water (duality Certification — The outlet stream from the reservoir is a Class C <br />tributary of the Swamp River and is regulated by the Army Corps of Engineers as a <br />federal wetland. The circulated Phasing Plan shows this outlet stream disappearing <br />under or being covered by a new proposed structure with parking area located on <br />Portchester Way. Please be aware that the Department strongly urges the prosect <br />sponsor to redesign this portion of the proposal so as not to fill, enclose, channelize, <br />realign or otherwise disturb federal wetland areas so as to be more fully protective <br />of these resources. Regardless, as the current proposal includes filling and/or <br />relocating federal wetlands on the site, the project sponsor should contact the US <br />Army Corps of Engineers in New York City (telephone: (917) 790-8411), for any <br />permitting the Corps may require. If a federal permit is required, then a Water <br />Quality Certification (WQC) from the DEC will also be required for any proposed <br />excavation or fill within federally regulated wetland areas. <br />6. Threatened/Endangered Species (Article 11) — <br />Indiana bat: According to records maintained by the NYS Natural Heritage <br />Program, the project site contains a known occurrence of the Indiana bat, a NYS <br />listed species (NYS Endangered). Specifically, -an Indiana bat bachelor colony is <br />located, on site, in an upland area of the site which is proposed for development <br />("picnic area" and storage shed). The project site is entirely within 2.5 miles of the <br />known occurrences of Indiana Bat and is considered occupied habitat. The current <br />proposal would apparently clear, or otherwise disturb, this Indiana bat bachelor <br />colony and associated habitat. As a result, Indiana bat roosting and foraging habitat <br />may be adversely affected or lost. The Department strongly recommends that the <br />project be redesigned so as not to disturb, clear or otherwise degrade upland <br />
